Agreement to Terms
By accessing or using the website at lbfencingandservices.com and engaging LB Fencing & Services (“we,” “our,” or “us”) for any fencing, pole barn construction, snow removal, or property maintenance work, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of our website and services.
Services Provided
LB Fencing & Services provides pole barn construction, fence installation, privacy fence installation, gate installation, fence and gate repair, staining and sealing, snow removal, handyman services, and free project estimates in the New River Valley, Virginia area. The specific scope, materials, and timeline for each project will be outlined in a written estimate or service agreement provided before work begins.
Project Estimates & Agreements
- All estimates are provided free of charge and are valid for 30 days from the date of issue unless otherwise stated.
- Estimates are based on the conditions observed at the time of the on-site assessment. Unforeseen conditions (e.g., underground utilities, rock, grading issues) may result in additional charges, which will be communicated and approved by you before proceeding.
- A written estimate or service agreement must be accepted (in writing, electronically, or verbally) before work begins. Your acceptance constitutes a binding agreement.
- Any changes to the agreed scope of work must be discussed and approved by both parties. Change orders may adjust the project cost and timeline.
Payment Terms
- Payment terms will be specified in your project estimate or service agreement. A deposit may be required before work begins on larger projects.
- Final payment is due upon completion of the project unless alternative arrangements have been agreed upon in writing.
- We accept cash, check, and other payment methods as communicated at the time of service.
- Late payments may be subject to a late fee as specified in your service agreement. Outstanding balances beyond 30 days may be referred to collections.
Cancellation Policy
- You may cancel a scheduled project by providing written or verbal notice at least 48 hours before the scheduled start date at no charge.
- Cancellations made less than 48 hours before the scheduled start date may be subject to a cancellation fee to cover materials already purchased and labor scheduling.
- If materials have already been ordered or custom-fabricated for your project, you may be responsible for the cost of those materials.
- We reserve the right to cancel or reschedule work due to weather conditions, supply delays, or other circumstances beyond our control. In such cases, we will reschedule at the earliest available date at no additional cost to you.
Warranty Information
- LB Fencing & Services stands behind the quality of our workmanship. We provide a workmanship warranty for a period specified in your service agreement from the date of project completion.
- This warranty covers defects in installation and labor. It does not cover damage caused by natural disasters, accidents, misuse, neglect, normal wear and tear, or unauthorized modifications.
- Manufacturer warranties on materials (e.g., vinyl fencing, metal panels, gate hardware) are separate and provided directly by the manufacturer. We will assist you in filing any manufacturer warranty claims when applicable.
- To make a warranty claim, contact us at (540) 274-4176 or [email protected] with a description and photos of the issue.
Liability Limitations
- LB Fencing & Services will perform all work in a professional and workmanlike manner in accordance with industry standards.
- Our total liability for any claim arising from our services shall not exceed the total amount paid for the specific project in question.
- We are not responsible for pre-existing conditions on your property, including but not limited to underground utilities, property line disputes, or soil conditions not visible at the time of assessment.
- It is the customer's responsibility to obtain any necessary permits and ensure property boundaries are accurately marked before work begins. We can assist with this process upon request.
- We are not liable for indirect, incidental, or consequential damages arising from the use of our services or website.
Property Access & Preparation
You agree to provide reasonable access to the work area on your property during the scheduled project dates. The work area should be clear of personal belongings, vehicles, and obstructions. If utility lines need to be marked, you are responsible for contacting Virginia 811 (or allowing us to do so on your behalf) before excavation work begins.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue mediation administered by a mutually agreed-upon mediator in the New River Valley, Virginia area. If mediation is unsuccessful, disputes shall be resolved through binding arbitration or in the courts of Pulaski County, Virginia, in accordance with Virginia state law.
